To ensure that you are not left unprotected in case of a worst-case scenario, you should follow a few basic rules. It can go so wrong: Suddenly and unexpectedly, there is a serious conversation with the board or HR manager. Managers and employees with excellent resumes lose their jobs, shortly after receiving the maximum bonus payout and having a very good performance review, they are told that the collaboration should end. "We can't imagine how we'll manage without you, but starting tomorrow, we'll give it a try." This could be summarized by a cynic. The justifications are often vague, "somehow it doesn't fit anymore," chemistry is mentioned, just like (sometimes) staged operational constellations. Since there are no grounds for dismissal, severance agreements are negotiated, and now it is important to consider one basic rule: In the end, anyone can be fired, it's just a matter of price. So, your lawyer will try to push up the severance payment, and because there are no grounds for dismissal, he has a good hand. The employer, on the other hand, has a weak hand and will try everything to push the price down. And now something comes into play that I notice more and more often and is absolutely annoying for those affected, that I am always surprised at how naive one can be. If an employer has no recognized grounds for dismissal, they look for material, which is often easy to find: Private emails from the office computer, even though it was verbally prohibited years ago and maybe even signed by you. Documents containing business secrets or high confidentiality that were sent to third parties via email or burned onto a CD or copied onto a USB stick and taken away. Or emails with content that is disrespectful towards the employer or boss, surfing on compromising sites. Travel expenses that were not quite correctly billed, private meal or drink invitations on company expenses, previously tolerated, now a perfect opportunity. Billed trips to further education or conferences and unfortunately a witness who knows that you traveled together in a carpool with colleagues. All of these are the things that make the heart of the company lawyer beat faster. Because now they can either try to turn it into a summary dismissal or lower the price through emotional pressure so much that it becomes a piece of cake. So, for your own sake, keep yourself clean throughout your working life, then you are invulnerable: Completely separate private and work phones, do not use the company computer for personal matters, because with every keystroke you leave traces that can be reconstructed. Strictly adhere to confidentiality rules, do not copy or send anything that does not belong in foreign hands, and think carefully about who you gossip about your boss or "those up there" with. Never try to beautify your travel expenses or expense reports and check what you blindly sign due to time constraints. If you do all of this, you have nothing to fear and could at least console yourself with a high severance payment in the unlikely event of the worst-case scenario.
